1. Agreement

These Terms of Use ("Terms") form a legal agreement between you and Saving Thoughts ("we," "our," or "us") governing your use of the Saving Thoughts voice journaling service, including the mobile applications, the website at savingthoughts.app, and any related features (collectively, the "Service").

By creating an account or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. The Service is not directed to children under 13, and we do not knowingly collect data from children under 13.

3. Your Account

  • You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
  • You must provide accurate, current information during registration, including a valid email address we can reach you at.
  • You agree to notify us promptly at [email protected] if you suspect any unauthorized access to your account.
  • You may not share, sell, or transfer your account to another person.

4. Your Content

You retain all ownership of the diary entries, audio recordings, photos, and other content you create in the Service ("Your Content"). We do not claim ownership of Your Content.

You grant us a limited, non-exclusive, worldwide, royalty-free licence to store, transmit, process, display, and back up Your Content solely for the purpose of providing the Service to you — for example, syncing your entries across your devices, running AI transcription on your audio, and generating daily summaries only after your explicit optional AI-sharing consent and when you have those features enabled. You can withdraw that consent in Settings. This licence ends when you delete the content or your account.

You are solely responsible for Your Content and confirm that you have the right to upload and process it under applicable law.

5. AI Credits & In-App Purchases

The Service itself is free to use. AI transcription is funded by prepaid AI credits, which you buy as a one-off purchase — no new subscription is required. Legacy subscriptions may remain under their original terms. Current credit packs and prices are shown on the in-app AI credits screen and at savingthoughts.app/#pricing.

  • Free credits: New accounts receive 10 free AI transcriptions on signup. Free credits are non-transferable, have no cash value, and may be modified or discontinued at any time for future signups without affecting credits already granted.
  • Billing platform: On iOS, credit packs are sold as consumable in-app purchases through Apple and billed to your Apple ID. On Android, they are sold through Google Play and billed to your Google account. On the web, they are billed through Stripe. Platform fees and refund policies are set by Apple, Google, and Stripe respectively.
  • What credit is: Credit is consumable and is spent as you transcribe, charged by the minute of audio at the rate shown in the app. It is not a currency: it has no cash value, cannot be transferred or exchanged for money, and can be used only for AI features inside the Service. Credit does not expire while your account is open, and is forfeited if your account is deleted or terminated.
  • Refunds: Purchases of AI credit are non-refundable once the credit has been used, except where a refund is required by law or granted under the policy of the store you bought from. iOS and Android refunds are handled by Apple and Google under their respective policies — we cannot issue refunds for purchases made through those platforms. Web refunds are considered on a case-by-case basis at our discretion. Where a refund is issued, the corresponding credit is removed from your balance. Nothing in these Terms limits any statutory refund rights you may have under applicable consumer-protection law.
  • Price changes: We may change credit pack prices and the per-minute transcription rate from time to time. Changes apply only to purchases and usage after they take effect; credit you have already bought is unaffected.
  • Using your own OpenAI key: On supported non-iOS platforms you may supply your own OpenAI API key, in which case transcription runs on your OpenAI account. You are responsible for that account, for the charges OpenAI bills you, and for keeping the key valid; we charge nothing for transcriptions made with your own key and take no responsibility for OpenAI's pricing, availability, or terms. You may remove your key at any time.
  • Existing Premium subscriptions: Premium is no longer sold. If you subscribed before that change, your subscription continues until the end of the period you have paid for, or until you cancel it through the store you bought it from, after which transcription uses free credits and AI credit like every other account.

6. Acceptable Use

You agree not to use the Service to:

  • Violate any law or infringe the rights of others
  • Upload content that is unlawful, defamatory, or infringes another person's intellectual property
  • Upload malware, attempt to breach security, or interfere with the Service's normal operation
  • Use automated means (bots, scrapers, crawlers) to access the Service, except for publicly-documented APIs used in compliance with their terms
  • Reverse engineer, decompile, or attempt to extract the source code of the Service, except to the extent permitted by law
  • Resell, sublicense, or redistribute the Service or any part of it
  • Create accounts using false identity information, or share a single account across multiple people

We may suspend or terminate accounts that violate these rules.

7. Third-Party Services

The Service relies on third-party providers to function:

  • OpenAI — optional speech-to-text transcription, text embeddings, semantic search queries and daily AI summaries after consent
  • Apple / Google — in-app purchase billing and delivery on mobile
  • RevenueCat — mobile purchase validation and credit delivery events
  • Stripe — web payment processing
  • Resend — verification and service email delivery
  • Firebase and Apple notification services — push delivery where supported
  • DigitalOcean — server hosting and storage infrastructure

Your use of third-party services through the Service is also subject to those providers' own terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of third-party providers.

8. Our Intellectual Property

The Service — including its software, design, logos, and trademarks — is owned by us or our licensors and is protected by copyright, trademark, and other laws. Nothing in these Terms grants you any right to use our name, logo, or trademarks without our prior written permission.

9. Service Availability

We work to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable for maintenance, updates, or reasons beyond our reasonable control. We may modify, suspend, or discontinue any part of the Service at any time; if we permanently discontinue the Service, we will give you reasonable advance notice and an opportunity to export Your Content.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including any warranty of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by applicable law.

AI transcription and summary features are produced by automated systems and may contain errors. Do not rely on them as the sole record of medical, legal, financial, or other consequential information. You are responsible for verifying any output of AI features against your original recordings.

11. Limitation of Liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, consequential, special, or exemplary damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of the Service.

Our total aggregate liability to you for any claims arising out of or relating to these Terms or the Service will not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD 100.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.

12. Termination

  • By you: You may stop using the Service and delete your account at any time via Settings in the app. Deleting your account permanently removes Your Content as described in our Privacy Policy.
  • By us: We may suspend or terminate your account if you materially breach these Terms, if we are required to do so by law, or if continuing to provide the Service to you would expose us to legal liability. Where practical, we will give you notice and an opportunity to cure the breach.
  • Termination does not entitle you to a refund of amounts already paid, including unused AI credit, except where required by law.

13. Changes to These Terms

We may update these Terms from time to time. For material changes, we will notify you by email at the address associated with your account and, where reasonable, through an in-app notice at least 14 days before the changes take effect. Continued use of the Service after the effective date means you accept the updated Terms. If you do not accept the changes, stop using the Service and close your account before the effective date.

14. Governing Law & Disputes

These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Service will be resolved in the courts of Hong Kong, except where applicable consumer-protection law in your place of residence grants you the right to bring proceedings in your local courts.
